RE:   Approval of Tentative Agreement with International Brotherhood of Electrical Workers

DATE:   November 15-16, 2001


Attached is a summary of the tentative agreement reached with the International Brotherhood of Electrical Workers (IBEW). The summary only includes those sections of the agreement that were modified during this round of negotiations.  The entire collective bargaining agreement is available on line at: https://mus.edu/hr/cba/collbarg.html. The IBEW represents 18 employees at Montana State University-Bozeman, Montana State University-Billings and The University of Montana-Missoula.  The bargaining unit has ratified the tentative agreement.

The tentative agreement provides for a 4% increase in wages on November 1st of 2001 and 2002. The foreman differential increased from $1.00 to $1.10 above journeyman scale and the stipend for fire alarm endorsement increased from 35 cents to 50 cents. The employer contribution for group insurance increased by $30 in FY 02 and $41 in FY 03 in accordance with state law.

Under the tentative agreement payroll deductions for U.S. Savings Bonds will no longer be mandatory. Sick leave and vacation leave may be used in a minimum of quarter hour increments. The provision on probationary periods was clarified to exclude time served in a temporary position. The reference to budgeted department was deleted from the seniority and layoff provisions. A grievance committee option was added to the grievance procedure.A new provision was added that incorporates the conflict of interest provisions included in state law. The most substantive language change was to the provision governing warning letters. Previously all warning letters were removed from employees personnel files after 6 months or 1 year. The tentative agreement mandates the removal of an employee's first warning letter after 1 year but subsequent warning letters may remain in employees personnel files indefinitely. All of the language changes included in the tentative agreement were initiated by the employer.

I recommend approval of the tentative agreement with IBEW.
